Welcome to Only August. These Terms of Service (“Terms”) govern your access to and use of the website www.onlyaugust.com (the “Site”) and any purchases made from us. By using the Site or placing an order, you agree to these Terms.

The Site is operated by Only August LLC (“Only August,” “we,” “us,” or “our”).

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By ordering, you represent that you are of legal age and have the authority to enter into a binding contract.

Products

We make every effort to display product images, colors, and descriptions accurately. However, due to monitor and lighting variations, we cannot guarantee that what you see on screen will exactly match the physical product. Specifications, features, and pricing are subject to change without notice.

Pricing and payment

All prices are listed in U.S. dollars. We accept payment through the methods displayed at checkout. By placing an order, you authorize us to charge your selected payment method for the total amount, including taxes and shipping. We reserve the right to refuse or cancel any order at our discretion.

Order acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to limit quantities, refuse orders, or correct errors in pricing or product information. If we cancel an order after payment, we will issue a full refund.

Warranty

Only August products come with a two-year limited warranty against manufacturing defects, beginning on the date of original purchase. The warranty covers repair or replacement, at our option, of products that fail under normal use due to a defect in materials or workmanship.

The warranty does not cover:

  • Damage caused by misuse, accident, neglect, or unauthorized modification
  • Normal wear and tear
  • Cosmetic damage
  • Loss or theft

To make a warranty claim, email hello@onlyaugust.com with proof of purchase and a description (and photos, if relevant) of the issue.

Intellectual property

All content on the Site — including logos, text, images, and product designs — is the property of Only August LLC or licensed to us, and is protected by copyright and trademark law. You may not copy, reproduce, or commercially use Site content without our written permission.

User conduct

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt unauthorized access, or to scrape content for commercial purposes.

Disclaimers

The Site and products are provided “as is” without warranties of any kind, except as expressly stated in our Warranty above. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the maximum extent permitted by law, Only August LLC’s total liability for any claim arising from your use of the Site or our products shall not exceed the amount you paid for the product giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Nassau County, New York.

We may update these Terms at any time. The “Last updated” date reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
